A
RESOLUTION OF THE BOARD OF MAHONING TOWNSHIP MUNICIPAL
AUTHORITY OF MONTOUR COUNTY SETTING water rates for
residential customers
WHEREAS,
this authority is a municipality existing under and
governed by the Municipality Authorities Act of 1945,
approved May 2, 1945, P.L. 382, as amended and supplemented
(the “Authorities Act”);
WHEREAS, this authority,
pursuant to authority vested in it by law and pursuant to
the request and consent of Mahoning Township, Montour
County, Pennsylvania, (the Township), has constructed or
acquired capacity within certain water transmission and
distribution facilities (the “Water System”) required for
rendering water service in and for portions of the Township:
and
WHEREAS, this Authority
desires to set its water rates for all residential
customers; and
WHEREAS, pursuant to its power
as set forth at 53 P.S. 306, the Authority desires to set
the current rates as outlined below,
NOW, THEREFORE, BE IT RESOLVED
by the Board of this Authority as follows:
The water rates for Mahoning
Township shall be set as follows effective January 1, 2009,
resulting in the following rates:
- For
all residential customers, the rate shall be Fifty-Four
dollars and 6 cents ($54.06) per quarter for the first
Six thousand (6,000) gallons of water used per quarter.
- For all residential
customers, any amount of water used in excess of Six
thousand (6,000) gallons per quarter shall be charged at
the rate of Three Dollars and seventy cents($3.70) per
thousand gallons.

This
Authority reserves the right, from time to time, to
adopt modifications of, supplements to, or amendments of
this Resolution.

This Resolution shall
become effective January 1, 2009

The provisions of this
Resolution are severable, and if any section, sentence,
clause, part, or provision hereof shall be held to be
illegal, invalid, or unconstitutional by any court of
competent jurisdiction, such decision of the court shall
not affect or impair the remaining sections, sentences,
clauses, parts, or provisions of this Resolution. It is
hereby declared to be the intent of the Board that this
Resolution would have been adopted if such illegal,
invalid, or unconstitutional section, sentence, clause,
part, or provision had not been included herein.
